1. Description of Service

CommentAI is a web application designed to help YouTube creators manage their channel's comments more efficiently using AI-powered tools, primarily Google's Gemini models. The Service allows users to connect their YouTube account, view comments, generate video summaries, analyze comment sentiment, and craft AI-assisted replies, among other features as described in our official documentation.

2. User Accounts and Responsibilities

Eligibility: You must be at least 13 years old to use the Service (or such other age as may be required in your jurisdiction to use online services). If you are under 18, you must have your parent or legal guardian's permission to use the Service.

Account Creation: To use most features of the Service, you must register for an account by signing in with your Google account. You are responsible for safeguarding your Google account credentials.

Accuracy of Information: You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.

Account Security: You are responsible for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

Your use of data obtained through Google APIs is also subject to Google's Terms of Service and Privacy Policy, and YouTube's Terms of Service.

CommentAI's use and transfer to any other app of information received from Google APIs will adhere to the Google API Services User Data Policy, including the Limited Use requirements.

4. Subscription Plans and Payments (If Applicable)

Free Plan: CommentAI may offer a free plan with certain usage limits (e.g., number of comments replied to per month), as detailed within the Service.

COMMENTAI, ITS SUBSIDIARIES, AFFILIATES, AND ITS LICENSORS DO NOT WARRANT THAT A) THE SERVICE WILL FUNCTION UNINTERRUPTED, SECURE, OR AVAILABLE AT ANY PARTICULAR TIME OR LOCATION; B) ANY ERRORS OR DEFECTS WILL BE CORRECTED; C) THE SERVICE IS FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS; OR D) THE RESULTS OF USING THE SERVICE WILL MEET YOUR REQUIREMENTS.

10. Limitation of Liability

IN NO EVENT SHALL COMMENTAI, NOR ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES, BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (I) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE; (II) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE; (III) ANY CONTENT OBTAINED FROM THE SERVICE; AND (IV) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, WHETHER OR NOT WE HAVE BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGE, AND EVEN IF A REMEDY SET FORTH HEREIN IS FOUND TO HAVE FAILED OF ITS ESSENTIAL PURPOSE.

11. Indemnification

You agree to defend, indemnify, and hold harmless CommentAI and its licensee and licensors, and their employees, contractors, agents, officers, and directors, from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including but not limited to attorney's fees), resulting from or arising out of a) your use and access of the Service, by you or any person using your account and password; b) a breach of these Terms, or c) Content posted on the Service.

12. Governing Law

These Terms shall be governed and construed in accordance with the laws of Tamilnadu, without regard to its conflict of law provisions.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us regarding our Service and supersede and replace any prior agreements we might have had between us regarding the Service.

13. Dispute Resolution

Any disputes arising out of or related to these Terms or the Service will be subject to final and binding arbitration. The arbitration will be conducted in Tamilnadu by a single arbitrator in accordance with the rules of the American Arbitration Association.
